NOTICE OF THE CONFIRMATION BY KILKENNY COUNTY COUNCIL OF A COMPULSORY PURCHASE ORDER
MADE UNDER SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT, 1966,
AS EXTENDED BY SECTION 10 OF THE LOCAL GOVERNMENT (NO. 2) ACT, 1960
AND AMENDED BY SECTION 213 OF THE PLANNING AND DEVELOPMENT ACT, 2000; ROADS ACTS 1993 TO 2007,
AS RESPECTS ALL OR PART OF THE LAND TO WHICH THE COMPULSORY PURCHASE ORDER RELATES
TO BE PUBLISHED IN ACCORDANCE WITH SECTION 78 (1) OF THE HOUSING ACT, 1966.
AS AMENDED BY THE PLANNING AND DEVELOPMENT ACTS, 2000 2004.

COMPULSORY ACQUISITION OF LAND KILKENNY COUNTY COUNCIL R699 Upgrade Scheme Knocktopher ;Western Section Compulsory Purchase Order(No. 1), 2007

Kilkenny County Council has, on the 30th January 2008 , made a confirmation order confirming the above named compulsory purchase order with modifications as respects the land described in the Schedule Part 11 thereto. The said order as so confirmed authorises Kilkenny County Council (hereinafter referred to as "the local authority") to acquire the said land compulsorily. It will become operative three weeks from the date of publication of this notice. A copy of the order as so confirmed and the maps referred to in it may be seen between the hours of 9.00 a.m. to 1.00 p.m. and 2.00 p.m. to 5.00 p.m. on working days at the following locations:

Roads Office, Kilkenny County Council 1,Dean Street, Kilkenny/Thomastown Area Office, Kilkenny County Council Thomastown, Co KilkennyCallan Area Office, Kilkenny County Council ,Prologue, Callan, Co Kilkenny

The order also authorises the local authority to extinguish the public rights of way described in the schedule Part 111 thereto, by order made by them after they have acquired the said land.

An application for judicial review of the decision of the Council under Order 84 of the Rules of the Superior Courts (S.1. No. 15 of 1986) may be made to the High Court within eight weeks of the date of publication of this notice in accordance with section 50 of the Planning and Development Act, 2000.
