Controlled burning of Agricultural Waste


It should be noted that Section 40 of the Wildlife Act 1976 states that it is illegal at any time to cut, burn or otherwise destroy vegetation NOT cultivated between 1st March and 31st August. There are no derogations from this law for the burning of vegetation. This law is in place to protect breeding birds. All wild birds are protected legally It should also be noted by the public that if a 999/112 call is received relating to any controlled burning event on their property, then the Fire Brigade will be mobilised to attend and extinguish the fire. All the costs associated with the attendance of the Fire & Rescue Service will be invoiced to the property owner.

Kilkenny County Council are accepting notifications for Agricultural Burning in line with the Waste Management (Prohibition of Waste Disposal by Burning)(Amendment) Regulations 2023 (SI No. 16 of 2023). The controlled burning must take place between 1st September 2023 and 30th November 2023 (inclusive).

This exemption, provided for under the Waste Management (Prohibition of Waste Disposal by Burning) Regulations 2009 (S.I. 286 of 2009), exists to allow farmers, in accordance with the waste hierarchy and as a last resort, to dispose of wastes generated by agricultural practices.
